The requirements for workrooms set forth in Part Three of the Workplace Regulation (Arbeitsstättenverordnung, AStV) apply, without any restrictions, only to permanent workstations, i.e. workstations where employees spend at least two hours daily to do their work. Part Three does not apply to social amenities which are governed by the provisions of Part Four. If workstations are used regularly by one person for less than two hours a day (i.e. photocopying rooms) or if the provisions relating to fictitious room partitioning can be applied, employers may claim that less stringent requirements should be applied with regard to a number of features, such as ceiling height, natural light or room climate.
