Prevention Period

The Labour Protection Act (ArbeitnehmerInnenschutzgesetz, ASchG) distinguishes between workplaces with more than 50 employees and those with up to 50 employees. See: On-site Inspection Model. For work premises with more than 50 employees, the Labour Protection Act provides for the following: The duration of the annual (overall) prevention time is determined on the basis of the number of employees to be afforded protection and, depending on the risk potential, amounts to 1.2 to 1.5 hours annually per employee. For night work 0.5 hours have to be added, and the prevention time for seasonal and part-time workers is calculated on a pro-rata basis. Employers have to allocate the calculated total prevention time as follows: for at least 40 per cent of the time, safety professionals have to be available, occupational health experts must cover at least 35 per cent of the time, and at the employer’s discretion the remaining 25 per cent may be added to the working hours of safety professionals, occupational health specialists or any other experts, such as chemists, toxicologists, ergonomists, but primarily occupational psychologists.
