On the basis of risk assessment at work, in particular, employers have the obligation to take action when near-misses have occurred or other circumstances or incidents have arisen that imply hazards or risks. The employers’ duty to keep records includes the obligation to also document near-misses. On the other hand, employees are required to report any near-accident and any critical incident to their immediate superiors.
